The development of the Internet, Artificial Intelligence, e-business,strong interstate and intercompany competitiveness, as well ascontemporary economic trends have highlighted the need for moreflexible business organization. The changing business environmentrequires employers to adapt to new circumstances and focus on one ofthe many restructuring models, involving inter alia the change ofemployer’s legal identity as a result of status change (merger,acquisition, division, separation) or legal transfer of an undertaking(sale, lease, outsourcing, subcontracting, etc). These changes entailpositive economic activities aimed at enhancing competitiveness,balancing profit and loss, enabling functional and administrativeunity, etc. However, the change of employer has a significant impacton employees, whose term of employment may be terminated oraltered to the detriment of employees, who may be transferred toanother employer. Hence, the cognitive objective of doctoraldissertation is: (1) to identify the concept and cases involving changeof employer, in order to understand the limits of implementation ofemployee protection regulations; (2) to point to the selectivesystematization, imprecisions and legal gaps which have practicalrelevance and consequences; (3) to determine the legal consequencesand emphasize the complexity of employees’ legal position duringand after change of employer; and (4) to investigate the level ofemployee protection in case of employer change in domestic,comparative and international law. It is achieved by applying socialscience and legal science methods. The pragmatic objective of thedissertation is: (1) to provide analytical overview, critically evaluatethe legal solutions for employee protection in case of employerchange, and determine whether positive law meets the legislator’srequirements; (2) to consider the possibility of improving employeeprotection to achieve social balance, based on the analysis ofinternational legal sources, comparative law and legal practice inneighboring countries and the Republic of Serbia, and (3) to offer delege ferenda proposals for system modification.
